1. INTRODUCTION

As SİBERLOCK SİBER GÜVENLİK VE DANIŞMANLIK HİZMETLERİ LİMİTED ŞİRKETİ (SİBERLOCK), since the date on which the Personal Data Protection Law No. 6698 ("KVKK" or the "Law") entered into force, we have attached great importance to protecting the personal data of all natural persons with whom we come into contact in any way while conducting our commercial activities, and to fully fulfilling the requirements of the KVKK in this respect. This Personal Data Protection and Privacy Policy (the "Policy") has been prepared to inform you about the processes and principles governing the recording, collection, use, sharing and storage of personal data by SİBERLOCK. This Policy sets out the principles governing the processing of data subjects' personal data by SİBERLOCK in the order in which they are regulated in the KVKK, and these explanations cover our SİBERLOCK employees and our active and prospective customers, whether natural or legal persons.

2. PROCEDURES AND PRINCIPLES FOR THE PROTECTION OF PERSONAL DATA

A. DEFINITIONS

The definitions of the terms and abbreviations used in this Privacy Policy are set out below.

Data Subject

This means the natural person whose personal data is processed. Under the KVKK, only the data of natural persons falls within the scope of the Law. The data of legal persons does not fall within the scope of this Law unless it contains information relating to a natural person.

Personal Data

Personal data means any information relating to an identified or identifiable natural person. For information to qualify as personal data, it must relate to a natural person, and that person must be identified or identifiable. The concept of personal data encompasses all information relating to a person, provided that the person is identified or identifiable. In this context, personal data includes not only information that directly reveals an individual's identity, such as their first name, surname, date of birth and place of birth, but also all data that makes a person directly or indirectly identifiable, such as telephone numbers, vehicle registration plates, social security numbers, passport numbers, CVs, photographs, video and audio recordings, fingerprints, genetic information, IP addresses, email addresses, hobbies, preferences, persons with whom they interact, group memberships and family information.

Special Categories of Personal Data

Special categories of personal data are data relating to a person's race, ethnic origin, political opinions, philosophical beliefs, religion, religious denomination or other beliefs, appearance and clothing, membership of associations, foundations or trade unions, health, sex life, criminal convictions and security measures, as well as biometric and genetic data.

Explicit Consent

This means consent that relates to a specific matter, is based on information and is expressed freely. A declaration of explicit consent is not subject to any formal requirement. What matters is that explicit consent contains the elements specified in the Law and can be demonstrated. Accordingly, explicit consent may be obtained orally, in writing, electronically or by similar means. However, where explicit consent is given in writing, the consent texts must be drafted clearly, understandably and simply. Explicit consent must also contain an affirmative expression of will.

Data Controller

This means the natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system. Such persons may be natural persons or legal persons such as public institutions, companies, associations or foundations. The data controller is the person who determines why and how the processing activity will be carried out.

Data Processor

This means the natural or legal person who processes personal data on behalf of the data controller based on the authority granted by the latter. The activities of the data processor are largely limited to the technical aspects of data processing. What matters here is that the data processor carries out personal data processing activities within this scope in accordance with the instructions received from the data controller.

Obligation to Inform

Under the obligation to inform, the data controller or the person authorised by it must inform the data subject of the identity of the data controller and its representative, if any, the purpose of processing, the persons to whom the processed data may be transferred and the purposes of such transfer, the method and legal grounds for collecting data, and the other rights listed in Article 11 of the Law. Fulfilment of the obligation to inform is not subject to the data subject's approval.

Personal Data Processing (Retention and Destruction) Policy

This means the policy on which data controllers base the determination of the maximum period necessary for the purposes for which personal data is processed, and the procedures for erasure, destruction and anonymisation.

Personal Data Processing Inventory

This means the inventory that data controllers prepare by associating the personal data processing activities they carry out as part of their business processes with the purposes of processing personal data, the data category, the recipient group to which the data is transferred and the group of data subjects concerned, and that they elaborate by specifying the maximum period necessary for the purposes for which personal data is processed, the personal data envisaged to be transferred to foreign countries and the measures taken regarding data security.

Application Form

This is the document that enables data subjects to learn whether their personal data is processed; request information if their personal data has been processed; learn the purpose of processing their personal data and whether it is used in accordance with that purpose; know the third parties to whom their personal data is transferred within the country or abroad; request rectification if their personal data has been processed incompletely or inaccurately; request erasure or destruction of their personal data; request that operations such as rectification, erasure and destruction be notified to the third parties to whom their personal data has been transferred; object to a result arising against them through the analysis of processed data exclusively by automated systems; and request compensation for damage suffered as a result of the unlawful processing of their personal data.
